Detailed analyses on RR Dist Collector order dated 15th March 2013.

Dear All,

The RR Dist Collector order dated 15th March 2013 is excellent and is rated 95% out of 100. 6 highlights are as follows:

The so called PTs bogus claim of the RDO not heard their grievances is negated by the Collector order. It shows very clearly that the order, mentions that the appeal by the so called PTs to grant ORC without any right over the said lands with RDO Chevella is dismissed vide common orders No. L/4446 and L/4447 of 2008 on 21st Aug 2009 is valid only after they heard them in detail. Their ( PTs) claim is without any basis is very clear. This shows that the quasi judicial authority like RDO can not reopen the case lost by the PTs in Apex Court. Interestingly, this case was not contested by our illegal association, slept over the matter for a year and they left it to fate. But, at the nick of the movement, I came to know through JC R R Dist and I took over the case and argued myself without any lawyer and we got the solid favorable order in our favor. Today it helped us a lot due to these 2 orders. The so called illegal GB and MC in the AGM 2010, they said that these orders has no significance. Thus it proved them wrong?
The appeal by the very same so called PTs with JC 1, RR Dist also was not contested by the illegal association. The case Nos. F1/4092, 4094 and 4095 of 2009 was argued by me in persons ( without any lawyers) and got the appeal dismissed and got yet again a favorable order in our favor on 5th Dec 2009. Both these copies are already with you ( sent by mail long ago) and/or can be also downloaded from thewww.greenfpoa.org website.
The order says very clearly that S.Chandrasekhar, R6, ( President Green Fields POA) filed documents and also filed written arguments. The points mentioned by me are very vital and those which are cited in the order are that (1) ORC was cancelled by JC, 1, RR Dist only after detailed inquiry vide order No F1/4578 of 1998 on 24th April 2002, (2) AP High Cour judgement ( WP 11777 of 2002 common order) was in favor of the government and the 2 crooks, Dr.P.Shankar Rao and Dayanand are twisting the order to their favor,( 3 ) Any review of the Apex Court orders are considered as contempt of court and must punish the errant like Shankar Rao and Dayanand.( 4) Very important point is that not even single application is submitted under GO Ms No 166 ( which is applicable for the entire AP state and not for just GF alone) by these criminal minded litigants and must be punished for their wrong doings.
The so called PTs are paid by us as out of court settlement ( though their tenancy is not proved by the time we paid) and their appeal with RR Dist court on their claim on these lands are withdrawn vide file dated 24th June 1996. Accordingly, the so called PTs rights on these lands are extinguished accordingly. This word has far reaching consequences on the so called PTs. This will help us to recover our money with an recovery petition in a criminal court.
The order also mentions that the first order by the RR Dist court No B3/3530 of 1996 dated 10th Nov 1997 also says that these are government lands. The same is followed by the 2nd order as said above.
Last but not least, in view of the forgoing findings, the RR Dist Revenue Court, finally said that these lands are government lands and the GF rights on these lands to regularization holds good.

But someone would have mislead the Collector that the AP High Court WP 15895 of 2010 has a status quo order. But no status quo order is issued by the court and the 3rd party claim on these government lands are not suppose to be entertained in case GO 166. Possible this point also missed her attention. Let me bring it to her attention and I have already submitted my appeal to her.

Photos of the function GF in the year 1996

Dear All,

The denial mode of the illegal committee members headed by so called illegal President aSatyam and so called illegal Joint Sec, Sadasheva Rao took yet another beating today, after few important photos taken during the Independence day function cum Tree Planting function in the year 1996 has surfaced. I was the one who was anchor cum master of the ceremony ( as seen in the pphotos) on that day and the photos are contributed by my childhood friend and ex committee member, ( who took pain those days to take photos) Mr.SVGK Murthy, who was kind enough to share these copies with me.

I have uploaded few of them today for you all to enjoy. Just see how young I was those days. These will be used when it mattered most to pin down these illegal elements, who were never seen those days in the colony and made their dubious presence felt with several illegal acts from 2000 to 2013, still doing several illegal acts even now. The man who claims as officiating Gen Sec, Sadasheva Rao, did not have even a plot in those years. Now he jumps like a jack as if he is the owners of the whole GF. He will be soon face the heat of the legal consequences and he and his family will suffer for his mistakes along with other co conspirators and their families and the so called illegally appointed lawyer, also will face the heat of the legal system.

RR Dist Collector issued orders in favor of Govt on the hearing

Dear All loyal members,

I am delighted to inform you that the RR Dist Collector issued orders in favor of the government on Green Fields hearing, a situation created by Dr.P.Shankar Rao, through his brothers and his 3 lady accomplish with an objection to not to regularization of our plots. All their ( 4 of them) contentions are dismissed and the old Collector order of these lands vest with government hold good.

However, unfortunately, she said in her order that the GO 166 can be implemented only after the deposing the WP 15895, which the old illegal association is still contesting with villagers from past 3 plus years without any results. I have sent a notice to Rajendran to give his NOC, as per convention for legal association to take over the case after the illegal association, after they lost the elections and also 2 cases in both Malkajgiri court and RR Dist court. But he and his illegal association members have not yet given the NOC, with an averment that they are still holders of the association with several contradictions within them. Now, I will consult our legal advisory board for legal action on them with few criminal cases soon. At least then, they will get senses?

The copy of the order will be sent by this night fall for your ready reference by mail only. No hard copies will be sent here on.

With regard to Lokayukta hearing today, the Chairman wanted few clarifications and the same is sought from the Collector RR Dist. They case is posted for 5^th June 2013.

In case of the the follow up action on NOC from the illegal association, it will be based on the number of members coming forward for a darna in front of Sadasheva Rao and Satyam houses with preempt police complaint on their illegal activities. Them only, we will get the NOC from the illegal association so that we can vacate the petition No WP 15895 from AP high court or else, it will take its own course, as it has taken in case of WP 3000 and WA 333 (they kept pending without any hearing for 15 months, with a unwritten understanding with the villagers and Dayanand, till I brought the AG in picture. ) and now I have made the AG to file his credentials and we can finish the hearing in no time. But these illegal elements will not allow us to work. Let all of you decide and revert to me what to do?

Major break through. Our deposition will be converted as Evidence under The Indian Evidence Act,1872

Dear All,

Yet another land mark development is that on my request with CID, the members deposing with CID, which was now only a statement, will be converted in to evidence of our property with documents under The Indian Evidence Act,1872

(The Act says that “Document”.—“Document”⁴ means any matter expressed or described upon any substance by means of letters, figures or marks, or by more than one of those means, intended to be used, or which may be used, for the purpose of recording that matter.)

This will make our right over the property more stronger since the land sale deed documents given by us during the deposing will be produced as our right over the property after it is verified by the police with Sub Registrars office at Begumpet as authentic. But the members must come forward now onward only those who are willing to come forward to court once to deposed at the time of the trail. I will give all the inputs for all those members who are willing to come to depose as well. Those who have already deposed also will be now added in to the Evidence category. No need to worry. Let us complete the local members first. Then we will plan for out station members. All are requested to be on stand by till further orders from me. Till the officials get the written orders to make it as evidence ( though now it is verbal, it will be in written to the department as internal communication), the deposing will be on hold for next few days. Fresh dates with new instructions will be communicated at later date.

High Court orders action against RR district joint collector

The High Court on Tuesday directed the principal secretary, revenue to inform the court about the action the government would take against M Jagannadham, joint collector of Ranga Reddy district, for handling the case pertaining to 22 acre of prime land in Kapra in Hyderabad. “All is not well with the Ranga Reddy district collectorate,’’ it remarked.

Justice Ramesh Ranganathan was dealing with a writ petition filed by Mustafa Begum and others.

The petitioners contended that they are Inamdars for the land and when it came to their notice that some persons were given Occupancy Rights Certificate (ORC) for this land without their notice, they filed an appeal before the joint collector-I of Ranga Reddy district collectorate.

They said that the officer had passed orders on January 19 granting status quo till February 23 but later corrections were made to the order and the hearing date was advanced to February 2 abruptly and their advocate was kept in dark.

A notice was displayed on Feb 2 (Saturday) in the office of the joint collector that hearing in all the cases has been adjourned and the counsel will be informed later about the next date of hearing in due course.

The petitioners complained that Jagannadham passed orders on February 4 (Monday) vacating the status quo orders.

The present writ petition was filed challenging the action of the joint collector. The case came up for hearing last week, and when the judge perused all the orders and the interpolations etc., he directed the officer to be present on Tuesday.

Following the direction, the officer came to court on Tuesday and tried to substantiate his action when the judge asked him to explain how such orders were passed behind the back of the appellants or their counsel.

Justice Ramesh Ranganathan expressed deep anguish at the state of affairs in the district collectorate and wanted action to be taken. He asked the principal secretary to report in a week’ time about the proposed action.

Reply to WRIT PETITION NO.16006 OF 2010 and way out

Dear All,

I am sure by now you all would have read the below sent mail by our committee member Sri.Mohan Babu garu on why we are not acting on very good order WP 16006 in favor of the GF. Let me clarify the issue with the following:

The petition was wrongly said as filed by the illegal GB that it was filed by them even before the AGM in the month of May 2010. They have not given the number. hence we do not know what was the petition all about.
They kept secret for whole period till I found out accidentally when one of the lawyers told me that one petition filed by your GF was not attended by our lawyer.
When I went to in to details, I found that this was filed by illegally appointed lawyer Rajender on behalf of the illegal association after several months after the AGM in which they said it is already filed, that too signed by unauthorized Joint Sec, great Sadasheva Rao who is not suppose file the petition as per their own forged and fabricated bylaws 2005 or even 2006.
I obtained the copies of this petition and studied and found that the same was not deliberately posted for hearing due to some match fixing between the villagers/Dayanand ( due to influence of Dr.P.Shgankar Rao with our ex illegal committee Presidents relationship.,
I met the registrar and got it posted and the order was issued in favor of the GF. But the so called GB of the illegal association did not act on that and just left it to it fate.
By then, the villagers filed Writ Appeal ( WA) 333 and obtained a status quo order.
It was yet again not followed by the illegal association for one full year.
Then I brought this to the notice of the then the dynamic Collector, Mr.Sheshadri garu and he was kind enough to ask me to seek AG support and I gave a representation to him
He endorsed the same to the Principle Sec, Revenue.
PS ( R) approved the same in record time and the same was taken over by AG and the status quo orders in both WA 333 and WP 3000 were vacated.
Now we can file an execution petition (EP) in the high court since WA 333 was vacated. But the illegal association was requested to give a NOC to file the same buy us since they are nothing to do with association and since they filed earlier, they must fulfill the formalities by giving NOC as per the law. They do all illegal things, bit I follow all the laws of the land. They have not responded till now to give NOC by their illegal lawyer Rajenderan who is busy with irrelevant case against me in Nampally court and wasting my time.
If at all I file EP without their NOC now, the criminals in the illegal association will yet again create ruckus in the court later as they did in case of WP 3000 and it will unnecessarily get struck and it may delay further as it happen in case of WP 3000.
The illegal association have not given till today the NOC. So we have to go to their ( Sadasheva Rao and Rajendran) houses in large number ( at least 300 ) and seek their NOC. Or else we have no option to keep quite.
If they do not give, all these 300 must go to Alwal PS or to the DCP Alwal and file a police complaint on their criminal activities. How many are ready?
Moreover, if they give NOC, I have to engage a lawyer and pay at least his expenses if not his fee, which many lawyer do not ask me now since I promised to pay them later. now funds are very tight. Many members, even watch from sidelines the whole affair and do not come forward to even lend me helping hand as loan without interest. To my last appeal, only few new members came forward. Or and otherwise, the old members, who have paid, paid again.

So all the members must think and come back to me.

Many resignation letters from illegal GF association tumbled from their cupboards

Dear All,

With deadline for mending the fences with me ran out on 28th Feb 2013 at 9 pm to all illegal association GB and MC members, the illegal association, so far run by aSatyam for 13 years and at last the association has crumbled under the heap of lies, fraud, forgery, falsification fudging and fabricating the documents, with misleading the public with several false statements on BPS,LRS and settlement to villagers along with GO 166 and so on. But now, with several resignation letters surfacing at my desk last few days, their lies of many so called GB and MC members still in the association with him in old letter heads of the so called illegal GF association in many circulars has been exposed today with tumbling of several resignations letters of >

Mr.SVGK Murty from 1st Nov 2010, that is on AP Formation day ( Copy attached), the same is ackn by the very great man Sadasheva Rao, These are not disclosed by them , which amouts to cheating, fraud and falsification along with fabricating the GF letters heads.
Mr.Ashok Kumar, a year back but yet again on 26th Feb 2013 ( Copy attached),
Mr.C.Anjaiah on 20th June 2012 ( Copy attached)
Mr.T.L Prasad with effect from Oct 2010. ( Copy attached)

I understand that some more will follow me with their copies of the resignations in couple of days and I have extended the olive branch to them till 15th of March 2013 to those select illegal committee members.

But all these names appeared in the letterheads of the circulars several times is only to show that they are united. But today he is left with handful of illegal members to run the association, still illegally with support of illegally appointed lawyer Rajendran. The Satyam boasting in the illegally organised EGM in the year 2010 June to conduct the election by end of 2010 was a pipe dream. Later, he sent notices only to colony to organize one so called AGM. But he retreated since he came to know that I have kept my petition ready to bring a stay from the court. The wrong doers will not survive for long. These illegal elements are living examples.

Coming to Purnachander Rao and Narasimhan joining the illegal committee, I understand that no intimation was given to both Purnachander Rao and Narasimhan by Satyam and according to source, aSatyam inducted them without their knowledge and no consent was given by them. But, we are yet to hear from the horse mouth with proofs in written. Let us wait and see what is their stand, whether they are still with illegal association (in the committee or even supporting them from outside) or with legal association with a circular to confirm their stand clearly.

Illegally appointed lawyer, Rajendran is not the part of this amnesty and he is no more allowed to be part of legal association since he filed yet another counter in Nampally court to complicate the case on me with personal grudge.

Let me also make it very clear that why I made these offers is that it is only to handle the much bigger issue ( regularisation) on hand than all these small internal quarrels/squabbles and wasting our time. After all, these all antagoniser's also benefit out of my efforts to get their lands.

If they have to join us,( both Purna and Narasimhan) they must write a circular under what circumstances they signed in a circular sent by Yogesh 18 months ago, accusing me of misuse of funds, which was proved to be false with my documentary proofs with my rejoinder immediately followed by me. They must make clear their position with a circular to colony with a copy to me are they satisfied and coming to me or they have some issues to be clarified. Or else, they are not with legal association for the near future.

Green fields is not a dalit issue; Shankar is land grabber, say victims

The Green Fields Plot Owners’ Association

Hyderabad : The Green Fields Plot Owners’ Association has said the land issue should not be given caste colour.
Referring to the claim of former minister Dr P. Shankar Rao’s daughter Sushmitha that her father has nothing to do with the land scam, the Association pointed out that even the Supreme Court had delivered judgment against him. Leaders of the association said the government was hesitating to take action against Shankar Rao because of political pressures.
Referring to the support of Dalit leaders to Shankar Rao, the victims questioned whether they (Dalit leaders) has no moral responsibility to protect the victims. They lamented that though they had been fighting for the past 30 years, no one was showing concern. They urged the Dalit leaders not to turn the Green Fields issue into a caste problem.
Stating that they were ready for an open discussion with Shankar Rao or anyone else on the issue, they questioned whether a Dalit leader could illegally grab lands of others. They also said it was not proper on the part of Dalit leaders to support Shankar Rao. They also alleged that Shankar Rao was involved in several land grabbing instances. They said if the government ordered a survey of the area, facts would come to light. They said if the State government could not handle the issue, it should hand it over to the CBI.
It may be recalled that Sushmita, daughter of Shankar Rao, had complained against the Neredmet police in the Musheerabad police station. She made the Chief Minister and 40 others respondents in her complaint. She alleged that the Neredmet police had behaved in an improper way with her father and demanded action against them. She claimed that her father had nothing to do with the Green Fields land issue.

మాజీ మంత్రి శంకర్రావుకు గ్రీన్ ఫీల్డ్ భూముల వ్యవహారంలో సీఐడీ అధికారులు శనివారం నోటీసులు ఇచ్చారు. ఈ వ్యవహారంలో తమ ఎదుట విచారణకు హాజరుకావాలని శంకర్రావును సీఐడీ అదేశించింది. కాగా, గత నెలలో ఇదే అంశంలో విచారణలో భాగంగా శంకర్రావును బలవంతంగా పోలీసులు అదుపులోకి తీసుకున్న నేపథ్యంలో అనారోగ్యానికి గురయ్యారు. దాంతో కొంతకాలం ఆయన ఆసుపత్రిలో చికిత్స పొందిన ఆయన్ను ఆస్పత్రి నుంచి మంగళవారంనాడు డిశ్చార్జ్‌ చేసిన సంగతి తెలిసిందే. అయితే ఆయన కుమార్తె సుస్మిత శనివారం సీఐడీ అధికారులకు లేఖను అందజేశారు. తన తండ్రి అనారోగ్యంగా ఉన్నందున సిఐడీ అధికారుల మందు విచారణకు హాజరు కాలేకపోతున్నారని ఆమె ఆ లేఖలో పేర్కొన్నారు. ఈ సందర్భంగా సుస్మిత మీడియాతో మాట్లాడుతూ మా నాన్న విచారణకు సహకరిస్తారని, ఒక వేళ రాలేని పక్షంలో మా ఇంటికి వచ్చి విచారణ చేసుకోవాలని, అందుకు పూర్తిగా సహకరిస్తామని ఆమె చెప్పారు.

హైదరాబాద్: గ్రీన్‌ఫిల్డ్ భూముల వివాదం కేసులో మాజీ మంత్రి, కాంగ్రెసు శానససభ్యుడు పి. శంకరరావుకు సిఐడి నోటీసులు జారీ చేసింది. ఈ కేసును హైదరాబాదులోని నేరెడ్‌మెట్ పోలీసుల నుంచి సిఐడి తన చేతుల్లోకి తీసుకున్న విషయం తెలిసిందే. ఈ రోజు శనివారం తమ ముందు హాజరు కావాలని సిఐడి అధికారులు శంకరరావుకు నోటీసులు జారీ చేశారు. అయితే, శంకర్రావు అనారోగ్యంతో సీఐడీ విచారణకు హాజరుకాలేకపోయారు. తండ్రి తరపున కూతురు సుస్మిత సీఐడీ విచారణకు హాజరయ్యారు. అనారోగ్యం కారణంగా తాను హాజరు కాలేకపోతున్నట్లు ఓ లేఖను శంకరరావు కూతురు ద్వారా సిఐడికి లేఖను పంపించారు. గ్రీన్ ఫీల్డ్ భూముల వ్యవహారంలో శంకరరావును పోలీసులు అదుపులోకి తీసుకున్న తీరుపై గతంలో తీవ్ర వివాదం చెలరేగింది. ఆయనను అదుపులోకి తీసుకున్న తీరును అందరూ ఖండించారు. అయితే, తాము విచారించేందుకే శంకరరావు ఇంటికి వెళ్లామని, స్టేషన్‌కు రమ్మంటే ఆయనే లుంగీ పైన వస్తానని చెప్పారని, తాము ఆయన పట్ల దురుసుగా వ్యవహరించలేదని పోలీసులు చెప్పారు. ఆ తర్వాత శంకరరావు అనారోగ్యంతో ఆస్పత్రిలో చేరారు. దుమారంపై ముఖ్యమంత్రి కిరణ్ కుమార్ రెడ్డి సిఐడి విచారణకు ఆదేశించారు. అయితే, శంకరరావు ఏ సమయంలో కూడా సిఐడి అధికారులకు సహకరించలేదు. దీంతో కుటుంబ సభ్యులను విచారించి సిఐడి అధికారులు ముఖ్యమంత్రికి నివేదికను సమర్పించారు. ఈ నివేదిక ఆధారంగా ఇద్దరు పోలీసులపై చర్యలు కూడా తీసుకున్నారు. తాజాగా, గ్రీన్‌ఫీల్డ్ వ్యవహారంలో శంకరరావుకు సిఐడి నోటీసులు జారీ చేసింది.

Shankar Rao Evades CID Probe

Former minister and Secunderabad Cantonment MLA P Shankar Rao, who was instrumental in getting the CBI inquiry conducted into several big leaders including YSR Congress party president Y S Jaganmohan Reddy, is now scared of facing the CID inquiry into the allegations against him in Greenfields plots scam.

The CID authorities sent summons to Shankar Rao asking him to appear before them for an enquiry into the land scandal, but the former minister expressed his helplessness to attend the probe. He sent a letter to the CID authorities through his daughter Sushmita that he would not be able to attend the inquiry for some time as he was not well.

“Whenever I get well, I will attend the probe,” he said.

Sushmita gave a tear-jerking twist to the whole episode. She told the media that her father would extend all cooperation to the CID authorities in their inquiry into the Greenfields lands issue.

“If he is guilty, let the government hang him. But please leave him alone now as he is terribly sick. If the CID authorities want, let them come to our house and make inquiries once he gets well,” she said

CID Summons Shankar Rao For Questioning: Rao Cites Ill-Health

The breaking news of the day is that the CID sleuths have summoned Dr.P.Shankar Rao and his co accused and accomplish with their documents to be present at their HQ for questioning them. All the news channels are flashing the news. Please get updated on the same.

Former Minister P. Shankar Rao was summoned by the CID to appear before the investigating officers on Saturday in connection with the Greenfields land controversy.

However Shankar Rao informed the CID that he would not be able to go over to the CID Office in view of his ill-health. A letter was sent by him to the CID.

It might be mentioned here the Greenfields Colony Welfare Association President S. Chandrashekar had filed a petition in the court alleging that the minister, his brother P. Dayanand and others had tried to claim rights over 75 acres of land in the colony at Kamnajiguda by allegedly presenting forged documents.

A criminal case was registered against them on November 9, 2011. Shankar Rao then obtained an order from the High Court staying his arrest. However the Neredmet police began investigations into the case after the stay order was vacated in October 2012.

A team of police personnel on January 31, 2013 went to the residence of Shankar Rao and virtually dragged him to the Neredmet Police Station for questioning him in connection with the case. The family members of the former minister were not present in the house when the police went there. However, he was later admitted to the hospital after he complained of chest pain.

The action of the police had triggered off a hue and cry among the Congress circles and also various weaker section organizations. Even as the Chief Minister’s baiters in the ruling party demanded a CBI inquiry into the alleged police high-handedness, the daughter of the former minister, Sushmita, filed a petition before the State Human Rights Commission, demanding action against the CM and the DGP for the manner in which her father was subjected to ill-treatment.

The CID on Saturday issued notice to Shankar Rao to come to the office for further questioning him in the case. However, Shankar Rao sent a letter through his daughter expressing his inability to attend in view of his ill-health.

Speaking to the media after submitting her father’s letter, Sushmita charged that a false case was foisted against him. He has not committed any wrong. If found guilty, he could be hanged, she observed and added that her father and family members would extend full cooperation to the investigating officers. She also said that the police could do the questioning of her father at their residence.

The CID officers have not revealed whether they would do the questioning of Shankar Rao at his residence or wait for him to become all right and then summon him once again. (NSS)
