‘Regularisation of house sites will be subject to writ orders’

A Division Bench of the Hyderabad High Court comprising Chief Justice Kalyan Jyoti Sengupta and Justice P.V. Sanjay Kumar on Monday made it clear that regularisation of house sites under encroachment would be subject to orders in the writs filed, challenging GOs 58 and 59. The cases were filed by Prof. P.L. Visveswar Rao and others, who contended that the Telangana State government had issued GOs 58 and 59 to regularise encroachments without evolving a mechanism to impose penalty and check misuse. They lamented that such large-scale regularisation was against public policy.
The Bench directed the government to file a counter affidavit and made it clear that regularisation would be subject to orders in the writ and that all applicants shall be informed accordingly.
