Dear Respectable Members of Green Field,
On behalf of all the Governing Body (GB) and
Management Committee ( MC) members of the GFPOA legal association, I welcome
all of you to this first ever officials AGM of GF today. I also welcome you all
to this meeting on behalf of the founder members of the GF, who are here to
support us in our endeavor. Also, I welcome those desired members of the Vani
Welfare Association, who have decided to join GF as well.
As I said earlier, “Before the Hon’ble court
of the Chairman MACT Cum 2nd Addl Dist Judge, RR Dist, NTR
Nagar, the Order No IA No 1437 of 2011 in OP No 431 of 2011 dated 28th March
2012 “ by dismissing the petition filed by the illegally run GFPOA’s
illegal Joint Sec, Sadasheva Rao, today, the AGM of the Green
Fields Plot Owners Association ( Legal)
is called for ratification of the GB/MC members nominations as
well as the extension of their tenure by 2 years. It is a
land mark in the annuls of the GF since the first legal governing body meeting
is taking place after defeating the illegal body running the association
affairs for 10 years in the election conducted by the AGM appointed Election
Committee and the illegal committee functioning has been put to an end with the
hon’ble court order and also with overwhelming support of the true and genuine
members of GF. The manipulative meetings with several adjustments to suit the
illegal elements, like dummy members planting, forging documents and fudging of
the bylaws without members approval in 2 meeting (one in AGM and one in EGM),
misuse of the members funds for their personal use by transferring in
to the personal account and manipulation of the GF accounts and so on has been
put to an end. Today, we will discuss the following as the final agenda of the
AGM approved by the Governing Body and Management Committee on the 14th April
2012. After the matter is reviewed one y one, all
the resolutions will be put to vote with members and the members are
requested to sign the ballet papers to be signed and returned at the
end of the meeting.
- Review of the court
case WP 3000, after dismissal of the WA 333,
Thanks to the present respected RR Dist
Collector garu proactive steps, based on my request to him to seek the support
of the Advocate General (AG) Govt of AP, to argue all our cases, the same was
conceded by him and the government issued a special order for the AG to
represent our all cases in AP High Court for speedy redress. These cases
follow up was assigned to the MRO garu and thanks to his best efforts, the WP
3000 was brought to the single judge bench for hearing and the same is pending
in the same bench to have final hearing on opening day of the court after the
summer vacations. Thankfully, the frivolous and false case No Writ Appeal 333
(WA 333), file by the villagers to claim the share of the lands has been
dismissed by the AP High Court and the orders read :
Quote:
“Evidently, the impugned order only directs
the first respondent ( Collector) to consider the applications made by the (GF)
members of the third respondent association, which have been pending
consideration for an unduly long period of time, without any reasonable cause.
In view of the scheme of the Government under GO Ms. No. 166 dated 16.2.2008 to
regularize the encroachments over Government lands on payment basis, the
observation of the learned Single Judge to dispose of the applications filed by
the members of the third respondent association in respect of the lands
occupied by them, expeditiously by a reasoned order, in accordance with law, we
do not see any illegality in the orders passed by the learned Single Judge
warranting interference by this court. Consequently, the writ appeal fails and
is accordingly dismissed confirming the order impugned. However it is made
clear that the appellants are at liberty to bring to the notice of the District
Collector, Rangareddy District – first respondent herein, about the pendency of
the writ petition, concerning the subject lands As a sequel to the
dismissal of the appeal itself, all the miscellaneous applications shall stand
dismissed. There shall be no order as to costs. ”
Unquote:
Consequently, as of now, we have only
one case with status quo order against GO 166 in AP High Court and hopefully,
if the AGM passes a resolution to remove a unauthorized legal counsel
Mr.Rajandran,( who claims that he is representing the illegal association and
also causing the hurdles) the WP 3000 will be seeing the light of the
day. I request all the members to vote this resolution of removing the
so called legal council with immediate effect.
"It is resolved that Mr.Rajendran, the unauthorized legal counsel
must be removed due to his conflict of interest and also due to the anti
association activities"

was passed unanimously. )
- Review of
the Survey and Regularization Processes.
As you all may know by now that the survey of
the boundaries of the GF was going on actively at a brisk phase a fortnight
ago, but it was unduly stopped by the illegal elements headed by Mr.Dayanand,
the blood brother of Dr.P.Shankar Rao, due to the fear of losing his total
control on the issue. Unfortunately, even the so called saviors of the
plots, the illegal association members, instead of supporting our best efforts,
either kept quite by not supporting our endeavor or had an understanding with
those elements to sabotage/undermine our efforts. I promise you that with
member’s active support coming in now, we will see that the boundaries are
marked as early as possible to start the individual plots survey with a special
order already issued for the same. I also request all the members to present
when the boundaries survey takes place to keep the minority illegal elements
out of the activity. All the members agreed to the proposal.
- Review of the future
plans.
Once the boundaries of GF are marked, the land
grabbers of the plots in survey numbers 375 will be identified. With
already special executive orders of the RR Dist Collector garu, the MRO is
ready for action on those plots for demolishing and we will see that it is done
with iron hands. When such activities take place, once you all are informed by
Email/SMS, you all must also take interest to show the unity among us by being
present, unlike earlier illegal association, which ruled the 10 years with
divide and rule policy, which created situation we are now in. “UNITED
WE STAND, IF DIVIDED, WE FALL, BETTER WE UNITE NOT TO FALL”. An active
follow up with government departments, we will be able achieve our goals. One
the titles are issued with GO 166, no one can touch us. Better we fight for our
right. I request all the members to join in my endeavor to support our team of
dedicated governing body and committee members to achieve the goals. Barring
the unforeseen circumstances and no hurdles are created by the illegal
elements, we have set target to finish the task within 6 months. Hope for the
best?
All the members appreciated the efforts of the
President and extended full support.
- Extension of the
Governing Body tenure by 2 years.
Since last AGM in the year May 2010,
forcefully called with our pressure by those illegal elements, the issue of the
election has dominated the GF. Though the elections were conducted by the
Election Officer, ( appointed by the members approval in the last AGM )
along with his team in very legal manner, it was not liked by the illegal
elements and created one hurdle after another. The issue has landed first
at Malkajgiri court and the same was dismissed and later it went to the RR Dist
court and again, it was dismissed. The illegal elements could not digest the
victory of ours and they are still spreading willfully wrong information to
only poison the minds of the members for regaining the totally lost foothold on
the affairs of the GF. It is only their own making and I offered for peaceful
solutions by talks several times publically but they never wanted any solutions
for their best known reasons. Since no credible alternative is emerging,
if you all have faith in the present team, I suggest you extend the support to
the body by 2 more years.
All the members were not for any change
in present set up with giving additional charge of Gen Sec to S.Chandrasekhar
and agreed for the following resolutions:
"It is resolved that Mr.S.Chandrasekhar will continue as President
for 2 years from the date of expiry of his present term"

the resolution was put to vote, it was passed unanimously. )
- And electing the New Gen Sec and one member,
who have fallen out of the association, along with whoever wanted to get
relived.
Since the Gen Sec position is vacant due to
the absence of the earlier elected Gen Sec, since the issue of 2 posts for one
person is silent in the bylaws 1992, the same will be looked after by the
present President concurrently till the issues on hands are settled. The legal
issues are at a very critical juncture, it is better to continue with present
body and also no need to take any new faces in the critical position of Gen
Sec. However, if no consensus emerging on this very important issue, I have few
alternatives to suggest. It is members to come with their open mind suggestions
in a democratic manner to settle the issue in amicable way. Consequently, one
management committee member left the elected association, the committee has
adopted a resolution last year to co-opted Mr.Nagarjuna Rao as member in the
absent members place. I wanted the AGM to ratify the same. As of now, no
member has evinced interest their position from the present body. Hence no
vacancies have arisen.
" It is resolved that Mr.S.Chandrasekhar will be concurrently
function as General Secretary till he appoints a Gen Sec at a later date or 2
years, whichever is earlier"
" It is resolved that all other Governing Body and MC members will
continue in their positions for 2 years from the date of expiry of their
present term".

the resolution was put to vote, it was passed unanimously. )
- Funds for the future
operations,
The total operations from past 3 years 4
months were funded by me and of course, I have only taken the loans from few
members, who have trusted me and supported me so far. The cost of the total
operations was to be calculated yet but the primary figure of spent is around
Rs.15 lakhs plus from past 40 month plus my personal debt of Rs.3 lakhs as loan
from outsiders and members. The suggestion to support for the future with funds
is left to the members with their will. But the committee feels that everyone
must come forward with subject to Rs.10,000 ( with one installment of 10k or 2
installment of Rs5000) has been proposed. If no controversy to be created on
the funds issue, I request to vote to this resolution. The accounts operational
details can be worked out. However, I do not wanted any of the members to
make any issue of funds at a later date, which may be leading to bad blood.
Those who wanted to contribute as fund must come forward only voluntarily and
no force will be applied. But once the issue is settled, every plots owner’s
liability will be decided on pro-rate basis and will be collected from every
member. Those who have paid more than the actual amount now in the fund,
the extra amount will be returned after collecting from every member. A special
committee will be formed for these collections for better transparency.
However, members have any better suggestions, you are welcome to do so. All the
members agreed for the proposal.
"It is resolved that subject maximum of Rs.10,000 per member and
minimum of Rs.5000 per members must be paid as emergency fund as loan and or
expenses by the members. It will be in to an escrow account for drawl from time
to time for expenses incurred by the members".

- Mandate to
President/Governing body for expelling the members who are indulging in
the anti association activities by scuttling the processes regularizations
with several hurdles and undermining the duly elected bodies’ efforts.Having
legal sanction to our governing body, the issue of the removal of the
illegally appointed ex illegal governing body and the lawyer Mr.Rajendaran
is very critical since he is causing lots of hurdles by representing the
illegal association in AP High Court by causing hurdles in WP 3000 as if
he is legally appointed lawyer. This is causing lots further delay in our
smooth operations of the settling the cases in the high court. Moreover,
his filing a frivolous and false case on the present sitting president
must be viewed as anti association activities and he must be shown the
door. A notice must be served to him for seeking his NOC in all
cases if at all he is representing illegally with support of the illegal
association committee members, particularly the so called officiating illegal
Secretary (self appointed), Mr.Sadasheva Rao, who is the illegal
association illegal Joint Sec and he must also must be shown the door if
he not mending the fences and accept the reality along with all the
illegal elements. Moreover, his involvement in filing a FIR on 2 present
committee members and one ex President and being one of the witness also
must be viewed as anti association activities as per the bylaws 1992.
Hence a Mandate is required to President/Governing body for expelling
these members who are indulging in the anti association activities by
scuttling the processes regularizations with several hurdles and
undermining the duly elected bodies’ efforts. My request to expel all the
illegal committee members must be passed. The members agrred for the same.
The resolution was put forth as follows:
"It is resolved that all the illegal committee members must be
removed from the association due to their illegal activities and defiance of
the association bylaws".
"It is also resolved that the members who are indulged in anti
Association activities must be suspended from the membership for 2 to 5 years
based on their illegal activities. The GB and MC is assigned the powers."

was passed unanimously. )
- Sub Committee for
Survey 375, to follow it up with concern officials.
I propose a special 5 members sub-committee
with 3 members from 375 plots owners and 2 from the governing body members
under Chairmanship of the President/Gen Secretary must be formed for periodic
review of the all important 375 survey to do justice to them as well. I request
members approve the suggestion for better coordination with the team.
This will facilitate quick solution to the issue and also will give better
leverage to fight the issue in a better manner since I am quite familiar with
the issue. Many members agreed for the same.
"It is resolved that a 5 members subcommittee will be formed to
follow up Survey No 375 issues under the Chairmanship of the President/Gen
Sec."

was passed unanimously. )
- Any other matter
with permission of the chair.
One of the items is that the Vijaya Bank,
not honoring our legally elected committee by following the illegally
running committee members statements must be viewed very seriously and must
taken as breach of trust and we must pass a AGM resolution to book a
criminal cases against the bank officials along with the illegally running 19
committee members. Or else, the issue may drag on further since all these
hurdles are thorn in the flesh created by these illegal elements. We
wanted all of you to view these issues to protect the larger interest of the
members than a personal ego clash or any other politics played by them.
Thankfully, based on our complaint to the Central Vigilance Commission, New
Delhi, the forgery and fraud in the Vijaya Bank account, on the CVC directions,
the matter was taken up by the Central Vigilance Officer of the Vijaya Bank,
Bangalore and will be followed it up by a separate 5 members special committee
for logical ends so that it will deterrent. 2 of them will be from Bangalore
based members and I request them to come forward to join the team for necessary
follow up once in 15/30 days on a typical weekends.
"It is resolved that a 5 members subcommittee will be formed to follow it
up the fraud issue with Vijaya Bank, Bangaluru/Hyderabad under the Chairmanship
of President/Gen Sec. "

was passed unanimously. )
A 5 members audit committee must be revived
for finding out the truth in the accounts frauds. The letters must be sent to
all the members signed by the committee Chairman (President/Gen Sec) and must
request for more details of the cash and cheque payments made to the illegal
committee members from past 10 years in the name of settlement to villagers, GO
166, BPS and LRS and so on and must be covered all the issues you have in your
mind and now you all will strengthen the hands of the present legal
committee. This committee will work on its own and report to the GB/MC.
All the members agreed and proposed for a resolution.
"It is resolved that under Chairmanship
of President/gen Sec, an audit committee must be activated to probe in to the
accounts of GF from past 10 years."

was passed unanimously. )
I hope and also request all of you to respond
positively and I am sure with your solid support getting extended from the
present set of strong supporters and further new members joining our movement
against corrupt MLAs Dr.Shankar Rao, who is under CBI scanner with our case
coming soon to AP High Court, also on ex illegal committee members, the matter
will be resolved soon by your support. Despite our best efforts to come for a
solution and compromise, the illegal committee stood their ground and filed 2 cases
in 2 courts and both of them were dismissed and did not respond to our call for
settlement for some unknown reasons. All these appeals have been sent as public
notices to them in colony and also to all the members by mail. Though they did
not respond due to their own reasons,
It is for the best interest of large open plot
owners, who are suffering in the hands of the illegal committee members, who
are predominantly the resident/house owners dominated in the illegal committee
in the past 10 years, headed by the so called illegal President Mr.Satyam and
his set of exploiters, who have exploited us for maximum, you all must join to
protect the open plot owners interest more with present committee. Thankfully,
we also have solid support of few sincere residents of GF, who are backing us
to take this movement forward for logical ends.
We wanted to place on record our sincere
thanks to those residents for their support, even by risking their lives with
these illegal committee members and also with the goons of the MLAs. The same
team will be our Colony Admn team ( CAT team) headed by Mr.Gyaneshwar,
Mr.Inayat Hasan, Mr.Rambabu, Mr.Dalappa, Mr.TSR Murty. Any of the colony
members wanted to join, they can send their request to us for considerations on
merit/first cum first basis.
All these years the issue dragged due to the
lack of leadership to fight the issue with professional approach. Now,
all of you must join hands with us for further strengthening the fight for our
rights. Or else, it will end with our peril, due to 3 way split in illegal
factions taking the advantage of the situation, by some joining the MLAs for
further exploitation. I am sure you all agree now and come forward to extend
with your helping hands? You are also welcome with your suggestions and
improvements in the whole operations "Green Fields". I also request
all the members to see our website www.greenfpoa.org , which is almost updated
on daily basis with several proofs of records of our issue. It also has press
cuttings, TV interviews and other important photo gallery for view. Please see
and give your feedback for further improvements.
It is not out of place to mention that the
contribution of the Vani Welfare Association member’s and also few unattached
plot owners for their support to us in the fight is well known from past 3
years without any preconditions. Hence we have also invited the unattached and VWA
members to participate in the AGM and they are rewarded free membership in the
GFPOA as one time chance. In case of the defunct Sree Sai Resident Welfare
Association, since majority/most of them members since already have joined
GFPOA and no request came from the handful of left over members to join us has
come, no offer is extended to them for now as open offer. However, those who
feel that they must join for their better future, they must contact their
erstwhile secretary Mr.Gyaneshwar or Mr.Inayat, Mr.Ram Babu, Mr.Dallappa ( who
are part of CAT team ) or so on for further processes of their request to admit
them on selective basis only.
Last but not least, I request every member who
is present here today to go back and bring in all those ignorant members in to
our fold to strengthen our fight against evil designs of the opponents and to
secure their plots as well. I also request every one of you, who are not in the
group mail list to register it and also update you cell numbers of every family
member of yours to receive update on the issues from time to time to join in
the efforts to strengthen our hands. I am happy that all the members agreed on
this proposal.
I thank all of you for supporting us in this
all important AGM to take it forward from here on to the logical ends and I
also wanted to thank especially all those members who have come from
outstation, on my request to join in this AGM. Let us give a standing ovation
to all of them for their special efforts. I also thank all those committee
members who have supported my efforts to take the issue forward and I also
thank all those members for their unstinted support to our committee in the
need of the hour. Let us hope to celebrate our victory soon at colony with our
achievements soon. GOD wiling it will sooner than later.
I thank Mr.Krishna Prasad for helping me to
organise the best lunch in the hot day and also thank all my co committee
members for their support to organize the meeting at this grand
scale. It is not out of place to mention the services of our member
Mr.D.Narasinga Rao garu, who helped us to get the SCR Railkalyana Mandapam with
his personal time spent on getting the place. Let us all of us thank
all of them for the same. If I have missed anyone, please pardon me for the
same for not thanking you but my thanks to every members for being present and
also a special thanks to those who came all the way from several long distance
places.
I also request for
full support to all these resolutions from those who could not be
present, though many are from Hyderabad and also those who are out of
Hyderabad, must download the resolution copies and sign and send the
same to strengthen the hands of the present committee. Those
who have were present in the AGM and forgot to give the copy signed by
them also must be sent by post by signing all the columns of the
resolutions as per their wish. I also request those members who were
present to give their comments and reactions as well for circulating the
same to other members to be more transparent.
